Apple Korea inc. hired a lawyer against customer’s sue who wants his iPhone 5 back

A customer who purchased brand-new iPhone 5(64G, White) with contract as date of 12 Dec 2012, he found his brand-new iPhone had a battery issue.
It kept being power-off even it had enough battery level or indicated “50% of battery level” but it dropped 40% shortly.

He visited customer care centre of Apple Korea as date of 14 Nov 2013 and requested to fix his iPhone. Technician said his phone will be fixed “partly”.

Apple Customer Care Center of Apple Korea made a call 5 days later and said that he has to pay KRW 340,00(USD 330) and will get refurbished iPhone back even his phone had product warranty valid for 1 year since his purchase.

He wanted his “own” iPhone back what used to his custody, but Apple Korea refused to bring it back. Apple Korea said “This is Apple Korea’s policy. Apple cannot return your iPhone back”.

From the date of 04 Dec 2013 to 24 Dec 2014, Korea consumer agency had arranged the arbitration for two parties. On 26 Dec 2014, Apple Korea refused all arbitration procedure from Korea consumer agency at the end.

On 12 Mar 2014, Apple Korea contacted their consumer and offered as following conditions and requested to close the case.
A.   Customer close case 1 against Apple Korea and return “it’s product” to Apple Korea and signed agreement
B.    Once Apple Korea received “its product”, Apple will wire full-amount of iPhone 5.
C.   Once customer receives the full-amount of iPhone 5, customer shall close case 2 as late before 24 Apr 2014.

“it’s product” refers customer’s brand-new iPhone(which belongs to Apple Korea’s custody now)

As 04 July 2014, he still doesn’t receive his iPhone. He sued against Apple Korea to bring his iPhone back. Apple Korea hired big law firm against this law suit case.
